Polish legislature changes procedures in recovering abducted children

Renata Majewska in her article published by Rzeczypospolita talks about recently approved changes by the lower house of the Polish legislature (Sejm) to change the procedures in dealings with international child abductions.
It is not yet clear from the article when the changes will take place.

Izabela Lewandowska z gazety Rzeczypospolita opisuje w swoim artykule postanowienie Sądu Najwyższego, w którym Sąd zdecydował, że opinia prywatnego biegłego psychologa jest jedynie faktem procesowym, a nie dowodem i przeto nie spełnia przesłanek potrzebnych do zaspokojenia wymogów artykułu 13 Konwencji Haskiej na temat nielegalnego uprowadzania dzieci za granicę.

KASACJA
Prywatna opinia, na którą powoływał się ojciec, nie jest dowodem Dziecko bezprawnie uprowadzone do Polski Sprawy o wydanie dziecka uprowadzonego za granicę należą do szczególnie trudnych – powiedział Sąd Najwyższy, uzasadniając wyrok z 19 grudnia, wydany w jednej z nich. Rozpatrujące ją sądy I i II instancji zrobiły wszystko, by ustalić, czy nie zachodzą przesłanki zatrzymania dzieci w Polsce. SN oddalił kasację kwestionującą prawidłowość ich werdyktów. Educating future lawyers and judges in Poland.

For quite some time now I have realized that the problem of poor compliance by the Polish judicial branch is caused mainly by the fact that the Polish judges and attorneys do not understand and do not know the law of The Hague Convention Treaty. I could not figure out however, how to make a dent in fixing this problem.

Most of the family law attorneys and judges do not speak English and do not have an access to the internet (which we take for granted these days in America) to study the subject. Most of the Hague cases are treated as regular custody cases. It was obvious during my almost 3-year legal battle in Gdansk. Other left-behind parents and the U.S. State Department also confirmed this discovery. Continue reading

Reason for poor enforcement of Hague Convention orders in Poland

Hi Folks,

I just received a fax from the Polish Central Authorities describing the procedure, which is used in Poland to enforce the Hague Convention treaty. Essentially, it is up to the left-behind parent to enforce the court decision to recover kidnapped children. As it stands today, Poland still fails to fully fulfill its Hague Convention obligations in this area …

In a nutshell, the kidnapping parent faces minimal Punishment and the process will take few more months (weeks, at best) should my wife decide to use all possible legal avenues. The maximum punishment for violating the court’s order is laughable… ~ 18.00 USD
