The way Polish legal system works or doesn’t

It seems that Polish courts found a way to keep the children in Poland, even after the abducting parent was initially order to return the child back to their homes abroad, and is still obligated to do so.

After a 3rd instance appeals have been removed by the Polish legislature for the family disputes (divorces, custody cases, Hague Convention cases…), the Polish judges of the regional courts feel that ignoring the Hague Convention Law is a valid option, and … they (the judges) are not afraid to use it.

In my case, the final court order to return my children: Amelia and Daniel back to their home in California, was issued in late 2001( after 2 very long years of adjudication!) and … nothing happened. Polish family court “tried” to enforce the order, but had no much “luck” or will – the mother decided to ignore it; she went  into hiding, and the local police “could not find” her for over 5 years;  the responsible judge refused to grant the permission to publish my children’s pictures in the media…). My patience is running out

I am in Amsterdam and I would like this story to be left on here if you don’t mind. I just had 2 of 5 days visitation with my son for a total of 6 hours. When the 3 hours were up friday the 30th of June 2006 my son waived to me to come to where he was standing. He said: “Dad, thanks for coming. I had a real good time today.” I took his face with both hands and I kissed him on the cheeck and told him “I love you very much Mycah.” The experts near the seen told the translator; he is very gentle with his son. I wish more fathers were like that.

European Court of Human Rights – are they for real?

I find decisions of the European Court of Human Rights to be just somewhat laughable. Polish parent who sued his government in the court in Strasburg for negligence by Polish justice system in enforcing his visitation rights was awarded astronomical amount of …..2000 euros. (that translates roughly to $2500!) . This includes all expenses that this poor father had to endure when fighting with the Polish apparatus of judges and social agencies.

It looks that the judges of this court believe that the European socialist governments have the right to screw their citizens, and any awarded penalties have no real meaning. The question for these judges is: What is the incentive for Poland and other governments to fix their bureaucratic incompetence? Your leniency? Continue reading

Poland still listed as “Country of concern”. Surprise, surprise…

Well,

Poland is again listed as a “country of concern” in the congressional 2004 report filed by the US State Department. The most interesing reading is included in the Attachement A and Attachement B
Please read the paragraphs that talk about Poland. How does the left behind parent (LBP) to trust the process. It looks that the goverment is only good to write reports, but as far as getting results, the conclusion is obvious - if you want to see your children again, you should take the law into your own hands.
