Laura Miceli was abducted by her Polish mother

I live in Paris.
In 1997 my ex wife (Renata Kwiecien; she is polish) abducts our little girl Laura (she was 3 years). A international warrant arrest was deliver by the french authorities against Renata Kwiecien and I have the exclusive parental rights for Laura. I have the legal custody for my daughter, but Polish court don’t respect anything at all French decision…Today I d like to find other parents in the same case..and i d like to meet a good atorney in Poland (at Kielce) Please somebody can help me…thanks in advanced, regard
Laura is 10 years now and I never see her again for 5 years now.
I think she always live in Poland (in Starachowice, near Kielce) and I would like to see her today very strong.

Hi im writing to you to inform you of my daughters abduction to Poland since last year. My ex wife and my self met in London in 1997 were we eventualy got married at the end of the year. Laoura our daughter was born on the 19/09/1998 and when she was three months old i found out that my wife had been married previous to an Italian. Without being divorced she went ahead into a marriage with myself commiting bigamy.

Cutting the long story short in January 2002 we attended court in the UK were i was given two days access with Laoura until the court decided who would get custody. Worried that i would get custody, in March 2002 she decided to give falce alligations to the police in the UK that i was sexually abusing my daughter. After two months of investigation the child protection team in the UK realised that she was lying about the whole story. Continue reading

Unfair Justice

POLAND: The Polish Central Authority has been cooperative and responsive in its dealings with the U.S. Central Authority. However, the U.S. Central Authority has informed the Polish Central Authority of concerns that the Polish judiciary is not fulfilling its obligations under the Convention, in large measure because it considers issues related to custody in Hague proceedings, makes inappropriate use of Article 13 (b), and affords uncertain, uneven enforcement of orders.

There is no specific legislation that implements the Hague Convention in Poland. Hague cases are generally not handled expeditiously. Unless there is a voluntary return, children normally remain in Poland during the entire appeals process, which usually takes a minimum of two years. Continue reading

Enforcing the law in Poland – the theory and reality

It’s a holiday season – Christmas, Santa Claus, presents, egg nog, etc – but forgive me if I don’t feel festive. It has been five (5) months since the District Appeal Court in Gdansk has issued its final ruling on my Hague Convention application to return the children to USA – and my children are still in Poland! One would think that it’s impossible. How can it be?

The simple reality is, that my wife went into hiding with the children. She insists that the children are her “sole property” and that the current situation she is putting them in is a healthy one. Sadly, a lot of people in Poland’s legal system seems to agree with her. Others seem to be helpless. Continue reading

New enforcement law is now in power

As I have already mentioned it before, the Polish legislature passed – and the Polish President signed it – a new bill that changes current court order enforcement procedures as they pertain to the Hague Convention cases.
