Educating future lawyers and judges in Poland.

For quite some time now I have realized that the problem of poor compliance by the Polish judicial branch is caused mainly by the fact that the Polish judges and attorneys do not understand and do not know the law of The Hague Convention Treaty. I could not figure out however, how to make a dent in fixing this problem.

I could not figure out however, how to make a dent in fixing this problem.

Most of the family law attorneys and judges do not speak English and do not have an access to the internet (which we take for granted these days in America) to study the subject. Most of the Hague cases are treated as regular custody cases. It was obvious during my almost 3-year legal battle in Gdansk. Www.gazeta.pl in today’s article (June 14,2001) described what really happened when Natalia J. was trying to execute her legal court order in Kielce, Poland last week.

The article in the www.gazeta.pl clearely describes, how it was due to the father’s illegal activities and inaction of the Polish government agencies, that the transition of the children between the parents did not take proceed in a rational manner. American Embassy in Warsaw has already sent an official diplomatic protest to the Polish Ministry of Foreign Affairs regarding the way the whole incident was handled by the Polish authorities.

Polish Human Rights Commissioner letter to Polish Ministry of Justice

On September 5th, 2000 Polish Human Rights Comissioner (Ombudsman) has contacted the Minister of Justice of Poland in regards to the
execution of courts orders in cases where a child was abducted to Poland.

On September 5th, 2000 Polish Human Rights Comissioner (Ombudsman) has contacted the Minister of Justice of Poland in regards to the execution of courts orders in cases where a child was abducted to Poland.

Ombudsman informed the Minister, that even though the procedure is documented in details by Polish law, and Polish government guarantees assistance, children are not forcefully return to parents abroad.

Complains received by Ombudsman suggest that parents have considerable difficulty in obtaining support during the execution of court orders. Courts do not execute its own decisions, and in the entire multi-step process there are in fact more remedies to the abductor parents. This situation compromises the credibility of Polish courts and Poland.

Amelia and Daniel Szuta kept captive since their vacation trip to Poland in 1998

On September 16, 1998 – 3 year old Amelia and 2 year old Daniel went to Poland (Gdansk) on a 4-month vacation with their mother, Alicja Holly-Szuta. On November 28th during the phone conversation mother of the children has announced to the father that is had filed for a divorce and refused to return with children back to California.
